Welcome to our online coursework platform. By accessing or using our website and services, you agree to be bound by these Terms and Conditions. Please read them carefully before using our platform.
1. Acceptance of Terms
By creating an account, accessing, or using any part of our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy. If you do not agree to these terms, you must not use our services.
2. Australian Consumer Law
2.1 Consumer Guarantees
Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (ACL) contained in the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot be excluded, restricted, or modified by agreement. Under the ACL, our courses and services come with guarantees that cannot be excluded. These include guarantees that:
- Services will be provided with due care and skill
- Services are fit for any purpose you make known to us
- Services will be delivered within a reasonable time
- Digital content is free from defects and fit for purpose
Where our services fail to meet these consumer guarantees, you are entitled to a remedy under Australian law.
2.2 Your Rights Under the ACL
If there is a major failure with our services (for example, the course content is substantially different from what was described, the content is not accessible, or the course cannot be completed), you may be entitled to a refund or other remedy. For minor issues, we will provide a remedy within a reasonable time.
3. User Accounts
3.1 Account Registration
To access certain features of our platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Use a strong, unique password for your account
- Not share your login credentials with any third party
- Notify us immediately of any unauthorized access or security breach
- Be solely responsible for any activity conducted through your account
4. Course Access and Usage
4.1 License Grant
Upon enrolment in a course and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to access and use the course materials for your personal, non-commercial educational purposes only.
4.2 Prohibited Uses
You agree not to:
- Copy, reproduce, distribute, or create derivative works from course materials without permission
- Share your account access with others
- Use the platform for any illegal or harmful purpose
- Attempt to compromise the security of our platform
5. Payment Terms and Pricing
5.1 Pricing
All prices displayed on our platform are in Australian dollars (AUD) and include GST where applicable. We reserve the right to modify pricing at any time, though price changes will not affect courses already purchased. All fees, including any delivery fees or mandatory charges, will be clearly disclosed before checkout.
5.2 Payment Processing
Payments are processed through secure third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge all fees to that payment method.
6. Refunds and Returns
6.1 Your Rights Under Australian Consumer Law
You are entitled to a refund or other remedy if our courses or services fail to meet the consumer guarantees under the Australian Consumer Law. This includes circumstances where:
- The course content is substantially different from what was described or advertised
- The course materials are defective, inaccessible, or do not work as intended
- The service is not delivered with due care and skill
- The course is not fit for the purpose you made known to us
For major failures, you may choose between a refund or a suitable replacement course. For minor issues, we will remedy the problem within a reasonable time at no cost to you.
6.2 Voluntary Refund Policy
In addition to your rights under Australian Consumer Law, we offer a voluntary 30-day satisfaction period for most courses. If you are not satisfied with a course for any reason within 30 days of purchase, you may request a refund by contacting us at hello@clearstone.au.
Please note that refunds for change of mind are subject to our discretion and may be declined if you have completed a substantial portion of the course (generally more than 30% of course content). This policy is in addition to, and does not limit, your rights under the Australian Consumer Law.
6.3 Refund Processing
Approved refunds will be processed within 5-10 business days to the original payment method. We will notify you once the refund has been processed.
7. Intellectual Property Rights
All content on our platform, including course materials, videos, text, graphics, logos, and software, are the property of our company or our content providers and are protected by Australian and international intellectual property laws. Subject to your rights under the Australian Consumer Law, you may not use, reproduce, or distribute any content without our prior written consent.
8. User-Generated Content
You may submit content such as course reviews, discussion posts, or project submissions. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating our platform.
You represent that any content you submit does not violate any third-party rights and complies with all applicable laws. We reserve the right to remove any content that violates these terms or is otherwise objectionable.
9. Privacy and Data Protection
We are committed to protecting your privacy and complying with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Our Privacy Policy explains:
- What personal information we collect and how we collect it
- How we use, store, and disclose your personal information
- Your rights to access and correct your personal information
- How we handle complaints about privacy
- How we protect your personal information from misuse, loss, and unauthorized access

10. Limitation of Liability
To the extent permitted by law, and subject to your rights under the Australian Consumer Law, we limit our liability as follows:
For consumers: If you are a consumer under the Australian Consumer Law, our liability is limited to, at our option:
- Re-supplying the services
- Paying the cost of having the services supplied again
For non-consumers: If you are not a consumer under the Australian Consumer Law, to the maximum extent permitted by law, we exclude all liability for any indirect, incidental, special, or consequential loss or damage.
Nothing in these Terms excludes, restricts, or modifies any guarantee, condition, warranty, right, or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.
11. Service Availability
We strive to provide uninterrupted access to our platform but may suspend or discontinue services for maintenance, updates, or other reasons. Subject to your rights under the Australian Consumer Law, we do not guarantee that our services will be error-free or available at all times.
12. Termination
We may suspend or terminate your account if you breach these Terms and Conditions. We will provide reasonable notice where practicable, except in cases of serious breach or illegal activity. Upon termination, your right to use our services will cease, subject to your rights under the Australian Consumer Law for any prepaid courses.
13. Variations to These Terms
We may update these Terms and Conditions from time to time. We will notify you of material changes by email or through a prominent notice on our website at least 30 days before the changes take effect. Your continued use of our platform after the effective date of any changes constitutes acceptance of the revised terms. However, any changes will not affect your existing rights under the Australian Consumer Law.
14. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Queensland, Australia. You agree that the courts of Queensland have non-exclusive jurisdiction to resolve any disputes arising from these terms or your use of our services. Nothing in this clause limits your rights under the Australian Consumer Law.
15. Dispute Resolution
If you have a complaint or dispute about our services:

- If we cannot resolve your complaint, you may contact your local consumer protection agency or the Australian Competition and Consumer Commission (ACCC)
- You may also have rights to seek resolution through alternative dispute resolution services or the courts
16. General Provisions
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of our services.
No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
